Terms of Service

Effective Date: April 11, 2026  |  BloomBK, LLC

These Terms of Service (“Terms”) govern your access to and use of the BloomBK platform, including our mobile applications, website, booking pages, and related services (collectively, the “Service”), operated by BloomBK, LLC (“BloomBK,” “we,” “our,” or “us”), a Delaware limited liability company.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Definitions

“Stylist” means an independent beauty professional (hair stylist, barber, nail technician, esthetician, or similar) who subscribes to BloomBK to manage their business.

“Client” means an individual who books appointments, receives messages, or otherwise interacts with a Stylist through the Service.

“Content” means text, images, photos, data, messages, and other materials that a user uploads, submits, or creates through the Service.

“AI Features” means functionality powered by artificial intelligence, including content drafting, business insights, onboarding assistance, and communication suggestions.

2. The Service

2.1 Description

BloomBK provides Stylists with tools for client relationship management, appointment booking and scheduling, payment processing (via Square), SMS and email communications (via Twilio and SendGrid), AI-powered content creation and business insights, website and booking page hosting, advertising campaign management, and business analytics.

2.2 Stylist Accounts

You must be at least 18 years old and legally able to enter into contracts to create a Stylist account. You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. You must provide accurate and complete information during registration and keep it updated.

2.3 Client Interactions

Clients interact with the Service by booking appointments through Stylist booking pages, receiving communications from Stylists, and making payments for services. Clients are not required to create a BloomBK account. Client data is managed by the Stylist and is subject to the Stylist’s own business relationship with the Client.

3. Subscription and Payments

3.1 Subscription Fee

BloomBK is offered at a flat monthly subscription fee of $99.99 per month. There are no booking fees, percentage-based commissions, or per-transaction charges from BloomBK. The subscription fee provides full access to all platform features.

3.2 Billing

Subscription fees are billed monthly in advance through Stripe. By subscribing, you authorize BloomBK to charge your payment method on a recurring monthly basis. If payment fails, we will attempt to charge the payment method on file up to three times over a 7-day period before suspending access.

3.3 Payment Processing Fees

Square charges processing fees on appointment payments made by Clients. These fees are set by Square (currently 2.9% + $0.30 for online payments, 2.6% + $0.10 for in-person payments via Square reader). Processing fees are passed through to Clients as a transparent, itemized line item on the booking page. BloomBK does not collect any portion of these fees.

3.4 Refunds

BloomBK subscription fees are non-refundable except where required by applicable law. If you cancel your subscription, you retain access to the Service through the end of your current billing period. Refunds for appointment payments between Stylists and Clients are governed by the Stylist’s cancellation policy and processed through Square.

3.5 Keep My Site

If you cancel your subscription, you may be offered the option to retain your website and booking page at a reduced rate of $9.99 per month (“Keep My Site”). This tier provides website hosting and booking page functionality only. All other platform features (CRM, SMS, AI features, advertising, analytics) are unavailable on this tier.

4. Appointment Payments

All appointment payments between Stylists and Clients are processed through Square. BloomBK facilitates the payment flow but is not a party to the transaction between the Stylist and Client. Each Stylist connects their own Square account to BloomBK via OAuth authentication. Payments are deposited directly into the Stylist’s Square account. BloomBK does not hold, escrow, or aggregate appointment payments at any point.

Stylists are solely responsible for setting their pricing, deposit requirements, cancellation policies, and refund terms. BloomBK is not responsible for disputes between Stylists and Clients regarding payments, services rendered, or refund requests.

5. SMS and Communications

5.1 Stylist Responsibilities

Stylists are responsible for ensuring that all SMS and email communications sent through BloomBK comply with applicable laws, including the Telephone Consumer Protection Act (TCPA) and the CAN-SPAM Act. BloomBK provides tools and safeguards to facilitate compliance, but the Stylist is ultimately responsible for the content and recipients of their messages.

5.2 Platform Safeguards

BloomBK enforces the following safeguards: no SMS is sent without verified opt-in consent recorded in our system; all messages include opt-out instructions; opt-out requests (STOP, CANCEL, UNSUBSCRIBE, QUIT) are processed immediately and automatically; consent records including timestamp and source are maintained for a minimum of five years; and all marketing emails include a working unsubscribe link.

5.3 Prohibited Messages

Stylists may not use BloomBK to send messages that contain false, deceptive, or misleading content; promote illegal activities; harass, threaten, or discriminate against any person; impersonate another person or entity; or violate any applicable law or regulation.

6. AI Features

6.1 Drafts, Not Decisions

AI Features generate draft content, suggestions, and insights for Stylist review. The AI never takes autonomous action. Every AI-generated recommendation requires explicit Stylist approval before the platform acts on it. The Stylist retains full control over all business decisions, communications, and published content.

6.2 Accuracy

AI-generated content may contain errors, inaccuracies, or suggestions that are not appropriate for your specific situation. You are responsible for reviewing, editing, and approving all AI-generated content before it is published or sent. BloomBK does not guarantee the accuracy, completeness, or suitability of any AI-generated output.

6.3 Data Usage

AI Features process aggregated business data to generate insights and content. Raw client records, payment data, and OAuth credentials are never provided to the AI system. Your data is not used to train AI models. See our Privacy Policy for complete details on AI data handling.

7. Content and Intellectual Property

7.1 Your Content

You retain ownership of all Content you upload or create through the Service, including photos, text, client data, and business information. By using the Service, you grant BloomBK a limited, non-exclusive, worldwide license to host, display, and transmit your Content solely for the purpose of providing the Service. This license terminates when you delete your Content or your account.

7.2 AI-Generated Content

Content generated by AI Features (website copy, blog posts, ad copy, SMS drafts) becomes your property once you approve it. You are responsible for the accuracy and legality of all Content you publish, whether you created it manually or with AI assistance.

7.3 BloomBK IP

The Service, including its design, code, features, documentation, and branding, is owned by BloomBK and protected by intellectual property laws. Nothing in these Terms grants you any right to use BloomBK’s trademarks, logos, or branding except as expressly permitted.

7.4 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant BloomBK a non-exclusive, perpetual, irrevocable, royalty-free license to use, modify, and incorporate that feedback without obligation or compensation.

8. Prohibited Uses

You agree not to: (a) use the Service for any illegal purpose or in violation of any applicable law; (b) attempt to access another Stylist’s data or account; (c) interfere with or disrupt the Service or its infrastructure; (d) reverse engineer, decompile, or disassemble any part of the Service; (e) use automated tools (bots, scrapers) to access the Service without authorization; (f) send spam or unsolicited messages through the Service; (g) use the Service to collect personal information of others without their consent; (h) sublicense, resell, or redistribute the Service; or (i) attempt to manipulate or bypass AI approval gates or safety mechanisms.

9. Third-Party Services

The Service integrates with third-party services including Square, Stripe, Twilio, SendGrid, Meta, Google, Anthropic, Cloudflare, and Supabase. Your use of these services is subject to their respective terms of service and privacy policies. BloomBK is not responsible for the availability, accuracy, or performance of any third-party service. If a third-party service experiences downtime or changes its terms, BloomBK will make reasonable efforts to maintain Service continuity but does not guarantee uninterrupted access to features that depend on third-party services.

10. Account Suspension and Termination

10.1 By You

You may cancel your subscription at any time through the Service or by contacting us at support@bloombk.com. Cancellation takes effect at the end of your current billing period. Upon cancellation, you may be offered the Keep My Site option described in Section 3.5.

10.2 By BloomBK

We may suspend or terminate your account if you violate these Terms, engage in conduct that is harmful to other users or the Service, fail to pay subscription fees after the grace period described in Section 3.2, or use the Service in a manner that creates legal liability for BloomBK. We will provide notice before termination when reasonably possible, except in cases of severe Terms violations or illegal activity.

10.3 Effect of Termination

Upon termination, your access to the Service will cease. Your booking page and website will be taken offline. Your data will be retained for 30 days to allow for data export requests, after which it will be permanently deleted in accordance with our Privacy Policy. Data retained for legal or tax compliance will be stripped of personally identifiable information.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BLOOMBK DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. BLOOMBK DOES NOT WARRANT THE ACCURACY OR RELIABILITY OF AI-GENERATED CONTENT. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLOOMBK’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO BLOOMBK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL BLOOMBK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF REVENUE, PROFITS, CLIENTS, DATA, OR BUSINESS OPPORTUNITIES, REGARDLESS OF WHETHER BLOOMBK WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

BloomBK is not liable for: (a) actions taken by Stylists toward their Clients or vice versa; (b) the quality, safety, or legality of services provided by Stylists; (c) disputes between Stylists and Clients; (d) losses resulting from third-party service outages; or (e) losses resulting from your reliance on AI-generated content without independent review.

13. Indemnification

You agree to indemnify, defend, and hold harmless BloomBK and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law, including TCPA, CAN-SPAM, and state consumer protection laws; (d) Content you upload, publish, or transmit through the Service; or (e) your negligence or willful misconduct.

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

14.2 Informal Resolution

Before filing any formal legal action, you agree to contact us at legal@bloombk.com and attempt to resolve the dispute informally for at least 30 days.

14.3 Arbitration

Any dispute that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in the State of Delaware. Each party shall bear its own costs. The arbitrator’s decision shall be final and binding.

14.4 Class Action Waiver

YOU AGREE THAT ANY DISPUTES SHALL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY AND NOT AS PART OF ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS ARBITRATION AGAINST BLOOMBK.

15. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and BloomBK regarding the Service.

Severability: If any provision of these Terms is held to be unenforceable, the remaining provisions shall remain in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. BloomBK may assign its rights and obligations without restriction.

Notices: We may provide notices to you via email, in-app notification, or by posting on our website. Notices to BloomBK should be sent to legal@bloombk.com.

Force Majeure: BloomBK shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, pandemics, government actions, or third-party service outages.

16. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by email and by posting the updated Terms on our website at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must cancel your subscription before the effective date.
